Transplantologists sew another case

Moscow transplantologists were accused of illegally removing organs from a Ukrainian

NBNIn the city of Vidnoye, Moscow region, a scandal broke out around the removal of internal organs from the deceased 19-year-old citizen of Ukraine, whose heart and kidneys were cut out, Russian media reported. 

Maxim Sholotyuk was admitted to the hospital of the city of Vidnoye on October 22 – having fallen from a three-meter height at a construction site, the guy received a severe head injury. The young man was diagnosed with a brain injury, Life News reports.

Two days later, on the night of October 25, the patient was diagnosed with brain death. Transplantologists from the Moscow Regional Research Clinical Institute arrived at the hospital and removed the deceased's heart and kidneys.

Maxim's father, Leonid Sholotyuk, came from Ukraine as soon as he learned about the accident with his son. According to him, he did not give any permission to take organs from Maxim.

"No one presented the documents to me, I didn't sign anything… Only when we raised a fuss and said that we would call the police and the prosecutor's office, the head of the morgue said that there was such a law allowing organs to be seized, they say, a team independent of the hospital arrives and makes a fence," Mr. Sholotyuk said.

According to the deputy chief physician of the Vidnovskaya CRH Nikolay Ivashchenko, we are talking about Article 8 of the Federal Law "On transplantation of organs and (or) human tissues." It refers to the presumption of consent to the removal of organs. The removal of organs or tissues from a corpse is not allowed if the health care institution has been informed that he did not want to do this during his lifetime, and close relatives or any representative have expressed their disagreement with the removal of these organs.

According to the lawyers, taking into account the fact that the deceased is a citizen of Ukraine, where the presumption of consent to transplantation does not apply, his relatives can file a civil lawsuit with doctors.

According to the published information, law enforcement officers began checking.

"If the facts of the article are confirmed, the verification materials will be transferred to the Investigative Committee for making a procedural decision," said Yevgeny Gildeev, head of the press service of the Ministry of Internal Affairs of the Ministry of Defense.
