The Federation Council approved the law "On the basics of protecting the health of citizens in the Russian Federation", which caused a lot of complaints from patients and professional communities, RIA Novosti reports.
This document should replace the "Fundamentals of the legislation of the Russian Federation on health protection", which entered into force in 1993.
It is planned that the new law, developed by the Ministry of Health and Social Development, will come into force on January 1, 2012. Some of its provisions requiring a transitional period will come into force in 2013 and 2015.
The document was planned to be adopted in the summer of 2011, but then, under pressure from organizations such as the National Medical Chamber headed by Leonid Roshal, the Pirogov Movement of Doctors, the Society of Evidence-based Medicine Specialists, the League of Patients, the Formulary Committee of the Russian Academy of Medical Sciences and others, as well as with the support of Russian Prime Minister Vladimir Putin, consideration of the bill was postponed for three months.
During this period, during additional discussions with representatives of the medical community and public organizations, about 100 of the proposed amendments were made to the document.
The new law prescribes the right of all Russian citizens to free medical care, including palliative care, and introduces uniform standards for its provision. The procedure for providing paid medical services is also being clarified.
The document allows the patient to independently choose a doctor and a medical institution. According to him, medical structures are obliged to insure civil liability to patients. Thanks to Roshal, professional medical communities have the right to participate in the development of standards, treatment protocols and tariffs in the CHI system.
The law introduces a mandatory "week of silence" between a woman's treatment and an abortion for up to 11 weeks of pregnancy, or "48 hours of silence" for a period of 11 to 12 weeks. Along with the permission of surrogacy, the new legal foundations of transplantation, including in children, and the permission to test schoolchildren for drugs, this item caused the greatest number of protests, up to hunger strikes.
The document officially prohibits human cloning and euthanasia, and also guarantees the provision of medicines to people with rare (orphan) diseases.
In addition, he makes significant changes to the system of professional medical education – cancels internship for polyclinic doctors and introduces mandatory accreditation of medical specialists.
