Conspiracy of pharmaceutical companies: FAS is on the trail

On May 11, 2011, the Federal Antimonopoly Service (FAS of Russia) will consider a case brought against 18 manufacturers and sellers of medicines on the grounds of collusion at auctions (violation of clause 2, Part 1 of Article 11 of the Federal Law "On Protection of Competition" – a ban on raising and maintaining prices at auctions).

The following distribution companies are suspected of cartel collusion in the market of medicines: CJSC "R-Pharm", JSC "Pharmstandard", LLC "Optimal Health", CJSC firm "CV "Protek", CJSC "ROSTA", LLC "Irvin 2", LLC "Gemamed", LLC "MEDIPAL-ONCO", LLC "MANAS MED", CJSC "CORAL MED", LLC "Advancedtrading" CJSC "Shreya Corporation", JSC "Pharmasynthesis", LLC "RUSRESURS" LLC "Medical leasing-consulting", LLC "Virend International", CJSC "PHARMACY-HOLDING", LLC "DiMedika".

According to the FAS of Russia, when the Ministry of Health of Russia conducted tenders for the purchase of medicines in 2008 - 2009. a number of companies admitted to the auction were present at the auction, but did not declare their bids for the price, or, having registered, did not appear to participate in the auctions. As a result, contracts were concluded with a single participant at the initial (maximum) price.

The FAS of Russia sees in this signs of violation of antimonopoly legislation.
