The law will protect the rights of embryos and the female reproductive sphere

The State Duma banned the use of human embryos for cellular products

RIA NewsThe State Duma on Tuesday adopted in the first reading a government bill that proposes a ban on the use of human embryos for the production of biomedical cell products in order to exclude the commercialization of this sphere.

The draft law on biomedical cell products will regulate the development, preclinical research, examination, state registration, clinical research, production, sale, storage, transportation, use, destruction, import into the Russian Federation and export from the country of biomedical cell products for the prevention, diagnosis and treatment of diseases, pregnancy preservation and medical rehabilitation, as well as in connection with with the donation of biological material.

"The bill prohibits the creation of a human embryo for the production of a biomedical cell product, as well as the use for the development, production and application of biomedical cell products of biomaterial obtained with interruption or disruption of the development process of the human embryo and fetus," said Deputy Minister of Health of the Russian Federation Sergey Kraevoy, presenting the bill in the State Duma.

At the stage of discussion of the bill, the director of the Department of Innovative Development and Scientific Design of the Ministry of Health, Andrey Vasiliev, noted that if the use of embryonic material is legalized, the commercialization of the female reproductive sphere may occur under a certain order. The possibility of using such a material will open up the prospect for some wealthy people to order cells with certain properties, he said. The planned conception of a person, "who will then be disassembled for spare parts, does not stand up to any criticism from a moral and ethical point of view," stressed the representative of the ministry.

Most likely, embryonic stem cells, whose cultures are isolated from blastocysts – balls with a diameter of 0.1 mm from several tens or hundreds of cells, will also fall under the ban. Blastocyst refers to the earliest period of mammalian embryogenesis – preimplantation (before attachment of the embryo to the uterine wall). After each in vitro fertilization procedure, several extra blastocysts remain, which are destroyed as biological waste – VM.

In addition, to ensure the safety and effectiveness of the use of a biomedical cell product, the draft law provides for its examination. There are also provisions for the production and use of personalized biomedical cell products containing the patient's own cells in medical activities.

The conditions for obtaining biological material from a donor for the production of a biomedical cell product are determined. At the same time, one of the principles of carrying out activities in the field of circulation of such products is the voluntary and gratuitous provision of biological material by the donor, it is noted in the explanatory note. It is established that the donor of biological material is a capable adult citizen.
